Conditions of Participation Big Dethleffs Competition

Participation in the Big Dethleffs competition is free of charge, irrespective of the purchase of products of Dethleffs and is governed exclusively by these conditions of participation. By taking note of these terms and conditions and deciding to participate in this competition, you accept these terms and conditions.

I. Organiser
The organiser of this competition is the Dethleffs GmbH & Co. KG (hereinafter referred to as "Dethleffs")

II. Eligibility
All natural and legally competent persons who have reached the age of 18 and are domiciled in the European Union, Norway, Switzerland or in the United Kingdom are eligible to participate. Employees of Dethleffs as well as their immediate family members and all persons involved in the conception and implementation of this competition as well as their immediate family members are not eligible to participate. The term "immediate family members" includes the following list: Spouse, common-law spouse, children or stepchildren (whether natural or by adoption), parents, stepparents, grandparents, step-grandparents, siblings, stepsiblings.
Only one participation per participant is permitted in the competition. Each participant may only participate in his/her own name; the personal details must be true. It is strictly prohibited to use multiple addresses or profiles to increase the chances of winning. Participation with fake identities or with identities of third parties is not permitted and will lead to exclusion from the participation

III. Exclusion of participation
Dethleffs reserves the right, at its own discretion, to exclude persons from participation if there are justified reasons. This is the case, for example, if there is reason to believe that a participant violates applicable law, the rights of third parties, the provisions of these terms and conditions of participation or the rules of the competition, in particular in the case of: 

• Manipulation in connection with access to or implementation of the competition 
• false or misleading information in connection with participation in the competition
• Offensive, derogative or discriminatory posts
• Contributions glorifying violence, xenophobia, pornography or racism
• Contributions with political or advertising content
• contributions that violate competition law, trademark law or copyright law.
• Irrespective of any further rights, Dethleffs shall be entitled in this case to take the following measures in particular:
• Exclusion of the participant with immediate effect
• Deletion and / or blocking of the contributions provided by the participant
• Subsequent revocation, if applicable, reclaiming of the prize and drawing of a new winner.

IV. Competition Participation

• To participate in this competition, please note and comply with the following:
• To take part in the competition, participants must register for the Dethleffs newsletter during the participation period. Registration can be made either in paper form at the trade fairs or online using the appropriate form. 
• In addition to the registration, a valid double opt-in for the newsletter must be submitted. For this purpose, a separate e-mail containing a confirmation link will be sent to the e-mail address provided in the competition. The participant must click on this link to confirm the e-mail address and activate the newsletter subscription. 
• Only participants who have successfully completed the double opt-in will be entered into the prize draw.

V. Participation period
Participation is only possible within the participation period. Attempts to enter after the closing date will not be considered in the draw.
Participation in the competition is possible from 30/08/2024 08:00 until 31/05/2025 23:59.

VI. Object of the prize

1. Main prize: A Dethleffs Camper Van Globetrail 600 ER in its basic equipment or standard equipment will be raffled off among all valid participants. The winner will receive the vehicle without any additional optional extras or packages. All additional optional equipment and packages that go beyond the basic equipment must be paid for by the winner.  
   The picture of the vehicle in the competition is for illustrative purposes only. The actual vehicle won may differ in colour and stickers from the model shown. There is no guarantee of an identical appearance of the vehicle. 
2. Payment of a prize in cash, in kind, its exchange or transfer to other persons is excluded. The winner may waive the prize. In this case, Dethleffs reserves the right to draw a new winner.

VII. Determination of prizes
The winner will be determined within 4 weeks after the closing date by means of a random draw among all participants who have taken part in the competition during the participation period and in compliance with the other conditions of participation. If the competition is linked to certain participation actions, only those participants who have correctly completed the participation actions will be entered into the draw.
VIII. Announcement of prizes
The announcement of the prize by naming the winner's first name and place of residence will take place within 8 weeks after the prize has been determined in the Dethleffs Newsletter.

IX. Notification & Acceptance of prizes
In addition, the winner will receive a direct message from Dethleffs to the e-mail address provided in the competition. Thereupon, the winner must contact Dethleffs by e-mail to hallo@dethleffs.de within one week after notification of the prize and provide a valid postal address.
If the winner does not contact us within one week of being notified of the prize, the prize will not be awarded. If the contact details provided are incorrect, Dethleffs is not obliged to find out the correct addresses. Any disadvantages resulting from the provision of incorrect contact details shall be borne by the participant. If a prize cannot be delivered for reasons for which Dethleffs is not responsible, the claim to the prize shall lapse without compensation.

X. Delivery of prizes
The vehicle is usually handed over at Dethleffs GmbH & Co. KG in Isny im Allgäu. If the winner has a correspondingly long journey, Dethleffs can arrange an alternative handover location at its own discretion. However, the decision on an alternative handover location is at the discretion of the organiser and is not guaranteed.
If the prize cannot be handed over for reasons for which the winner is responsible, the claim to the prize shall lapse.

XI. Premature termination of the competition
Dethleffs reserves the right to prematurely terminate the competition in whole or in part or to change its course at any time, also without observing deadlines and without prior notice and without notification of reasons, if it is not possible for technical reasons (e.g. computer virus, manipulation of or errors in software/hardware) or legal reasons to guarantee proper and scheduled implementation of the competition. This also applies if, during the implementation, Meta's promotion guidelines are changed so that implementation is not possible in accordance with Meta's valid regulations, or if the competition is stopped by Meta.

XII. Liability
The following exclusions and limitations of liability shall apply to Dethleffs' liability for damages, without prejudice to the other statutory requirements for claims:
Dethleffs shall be liable without limitation insofar as the cause of the damage is based on intent or gross negligence.
Furthermore, Dethleffs shall be liable for the slightly negligent breach of essential obligations, the breach of which jeopardises the achievement of the purpose of the contract, or for the breach of obligations, the fulfilment of which is essential for the proper implementation of the competition and the observance of which the contractual partners regularly rely on. In this case, however, Dethleffs shall only be liable for the foreseeable damage typical for the contract. Dethleffs shall not be liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.
The above limitations of liability shall not apply in the event of injury to life, body or health, for a defect following the assumption of guarantees for the quality of a product and in the event of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
Insofar as the liability of Dethleffs is excluded or limited, this shall also apply to the personal liability of employees, representatives and vicarious agents of Dethleffs.
If claims arise due to or in connection with a raffled trip or individual travel services, Dethleffs shall not be liable for this.
In particular, Dethleffs cannot be held responsible for any technical malfunctions, especially failures of the network, electronics or computers. Dethleffs is not liable for the availability of Meta and the comment function used there and cannot be held liable for any technical malfunctions occurring there.
The participant confirms and warrants to Dethleffs that his/her contribution within the scope of the competition does not violate legal regulations, morality or the rights of third parties (e.g. trademark, name, copyright, data protection or youth protection law). In particular, he/she also undertakes to obtain the legally required consents of the participants/persons concerned/authorised persons, for example the photographers or the persons depicted or named, before posting texts, images or other content. The participant indemnifies Dethleffs against any claims by third parties resulting from a breach of these obligations and agrees to compensate Dethleffs for any resulting damages, including reasonable legal defence costs.

XIII. Data protection
Participation in the competition requires the provision of personal data (first and last name, e-mail). The participant assures that the personal information provided by him/her is true and correct.
Dethleffs is responsible for the collection, processing and use of participants' personal data. Dethleffs will only use the participant's personal details and other personal data within the framework of the statutory provisions of data protection law. XIV. Platform-relevant notes
Participants may not raise any objections against Meta arising in connection with the use of Meta or participation in the Competition. Participants acknowledge that the competition is in no way sponsored, endorsed or organised by Meta and is in no way associated with Meta. All information and data communicated by or collected from entrants through the use of the Competition is provided solely to Meta and not to Meta. All enquiries and notices regarding the Competition should be addressed to Meta and not to Meta.

XV. Final Provisions 
Legal recourse with regard to the implementation of the competition and the prize draw itself is excluded. 
Should any provision of these Conditions of Participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these Conditions of Participation. Instead of the invalid provision, the legally permissible provision that comes closest in economic terms to the meaning and purpose expressed in the invalid provision shall apply. The same shall apply in the event of a loophole in these Conditions of Participation.
Dethleffs reserves the right to amend these Terms and Conditions of Participation at any time with effect also within the current competition, insofar as this is necessary due to changes in the law, changes in case law or other changes in the general conditions, in particular in the event of a change in the promotion guidelines of Meta.
